The CodeStream Privacy Policy explains how we collect your personal data, with the strictest respect for your rights, and how that data is used. When we talk about “CodeStream,” “we,” “our,” or “us” in this policy, we are referring to CodeStream, Inc.

Definition and Nature of Personal Data

During your use of the services that can be accessed on our website, https://codestream.com, later referred to as "CodeStream", we may require you to provide us with personal data. “Personal data” means any data that enables a person to be identified, e.g. your family name, given name, photograph, or email address, as well as any other information with which you choose to provide us.

CodeStream uses cookies to record log data. We use both session-based and persistent cookies.

Cookies are small text files sent by us to your computer and from your computer or mobile device to us each time you visit our website or use our desktop application. They are unique to your account or your browser. Session-based cookies last only while your browser is open and are automatically deleted when you close your browser. Persistent cookies last until you or your browser delete them or until they expire.

Some cookies are associated with your account and personal information in order to remember that you are logged in. Other cookies are not tied to your account but are unique and allow us to carry out site analytics and customization, among other similar things. EU-US Privacy Shield and Swiss-US Privacy Shield

When transferring data from the European Union, the European Economic Area, and Switzerland, CodeStream relies upon a variety of legal mechanisms, including contracts with our users. CodeStream complies with the EU-U.S. and Swiss–U.S. Privacy Shield Frameworks as set forth by the U.S. Department of Commerce regarding the collection, use, and retention of personal information transferred from the European Union, the European Economic Area, and Switzerland to the United States. CodeStream is subject to oversight by the U.S. Federal Trade Commission. JAMS is the US-based independent organization responsible for reviewing and resolving complaints about our Privacy Shield compliance — free of charge to you. We ask that you first submit any such complaints directly to us via privacyshield@codestream.com. If you aren't satisfied with our response, please contact JAMS. In the event your concern still isn't addressed by JAMS, you may be entitled to a binding arbitration under Privacy Shield and its principles.

Within the scope of our authorization to do so, and in accordance with our commitments under the Privacy Shield, CodeStream will provide individuals access to personal data about them. CodeStream also will take reasonable steps to enable individuals to correct, amend, or delete personal data that is demonstrated to be inaccurate.

CodeStream is responsible for the processing of personal data it receives, under the Privacy Shield Framework, and subsequently transfers to a third party acting as an agent on its behalf. CodeStream complies with the Privacy Shield Principles for all onward transfers of personal data from the EU, including the onward transfer liability provisions.

Notice and Choice of Data Processing

To the extent permitted by the EU-U.S. Privacy Shield and the Swiss-U.S. Privacy Shield frameworks, CodeStream reserves the right to process personal information in the course of providing professional services to its Controllers without the knowledge of individuals involved.

Where CodeStream collects personal information directly from individuals in the EU or Switzerland, it will inform them about the purposes for which it collects and uses personal information about them, the types of third party Controllers for which CodeStream discloses that information, the choices CodeStream offers individuals for limiting the use and disclosure of personal information about them, and how to contact CodeStream.

Where CodeStream receives personal information from its subsidiaries, affiliates or other Controller entities in the EU or Switzerland, it will use and disclose such information in accordance with the notices provided by such entities and the choices made by the individuals to whom such personal information relates.

Legal Requirements

We may disclose your Personal Data if required to do so by law or in the good faith belief that such action is necessary to (i) comply with a legal obligation or lawful requests by public authorities, including to meet national security or law enforcement requirements, (ii) protect and defend the rights or property of CodeStream, (iii) act in urgent circumstances to protect the personal safety of users of the Services or the public, or (iv) protect against legal liability.

Modifications

We may change this policy from time to time, and if we do we will post any changes on this page. If you continue to use the Services after those changes are in effect, you agree to the revised policy.
